Terms of Sale
« CyclesBasement.com », hereafter referred to as « the Website », id edited by the company mVmt SARL with capital of 5300 euro, which headquarters are located CLERMONT-FERRAND (63100) – 109 Rue du Cheval, identified at the RCS of Paris by Number 52961439800012, VAT Number FR84529614398, hereafter referred to as « the Company mVmt ».  All orders made on the Website are subjected to this terms and conditions of sale. The Company mVmt reserves the right to adapt or modify at any time the general terms and conditions of sale, the version of the general terms and conditions of sale applicable to any transaction are those given on the Website at the time of the order.

I – The Customer

The Customer declares to be a physical person aged of at least 18 years and to have the legal capacity or holds parental permission allowing him to place an order on the Website. Upon the registration of the Customer's pesonal data in the « My Account » section, the latter must ensure the accuracy and completeness of the required data. In case of error in the address of the recipient, the Company mVmt would not be held responsible for not delivering the product. The Company mVmt reserves the right to cancel any order when the IP address of the Customer is located in a country different from the billing address and / or delivery.

II – The Products

The products offered for sale are those described on the Website. The Company mVmt takes great care in the presentation and the description of these products to best meet the information given to the Customer. However, the customer acknowledeges and accepts that the Website may contain minor errors. In any case, if the delivered product does not comply with the description given on the Website, the Customer would be able to use, either his right of withdrawal, or the warranty of conformity given by the Company mVmt which will proceed the exchange or the reimbursement (all or part) of the price that could have been possibly charged.

III - The Order

An order taken on the Website is subjected to the respect of a procedure implemented by the Company mVmt. The procedure consists in multiple steps that the customer must absolutely follow to validate the order. The customer have the possibility, before definitively validate the order, to check the details and total price of the order and to correct possible errors, before confirming the order to express acceptance. Any order confirmed by the Customer holds as sales contract and entire acceptance of the general conditions and terms of sales.

The company mVmt will decline any order from a customer with which there has been an issue with the payment of a previous order or which violates the general conditions and terms of sales. 
In this case, the copany mVmt will informe the Customer by email. In the event the Customer corrects the erroneous elements or those contrary to the terms of sales, the Company mVmt reserves the right not toprocess the order.

A confirmation email summarizing the order details (products, price, quantity, availability, etc.) will be sent by the Company mVmt to the customer. To this end, the Customer formally accepts the use of email for the confirmation of the content of the order by the Company mVmt. In anay event, invoices are included in the delivered package.


IV – Pricing and Payment Options


1. Pricing


Products prices are quoted in euros, all taxes included, excluding shipping costs. The total price of the order (taxes and shipping costs included) is indicated in the basket.

The Company mVmt reserves the right to modify the prices constantly but the products will be charged based on the rates in effect at the time of the order, subject to availability.



2. Payment options


Products are payable on the day of the order. 

Payment are carried out either by :



a. Credit card


The Customer accesses a dedicated space provided by the bank which provides security and the registration of the payment order. In this regard, the Customer expressly acknowledges that the disclosuer of his credit card number to the Company mVmt constitute an authorization to debit his account to the amount of products order.



b. Bank transfer
The data recorded and stored by the Company mVmt constitutes proof of the order and of all transactions.The data recorded by the payment system constitutes proof of financial transactions. Any transfer requires a clearing delay of 10 working days before the order is validated.

c. PayPal
The Customer accesses a dedicated space provided by PayPal. The latter is created by the secured website PayPal.com (PayPal Europe S.à r.l. & Cie, S.C.A. 22-24 Boulevard Royal. 5e étage. 2449 Luxembourg) that uses the SSL (Secure Socket Layer) protocol so that the transmitted data is encrypted by a software and that no third party can read it during the transit over the Internet.

The Customer must hold a PayPal.com account to pay the order. If not, the Customer must use an option dedicated to non-account holders provided on the PayPal.com payment webpage.

If the Customer wants to use the PayPal to pay the order, he can connect at http://PayPal.com/ and follow the instructions . Opening a Paypal account is free.

The company mVmt cannot be held responsible by the Customer of the consequences neither of a misuse of teh PayPal.com website nor of an inaccessibility of the website.

V - Delivery

All packages from 0 to 20 kg are delivered by La Poste by Colissimo for France. Internaltionally, the weight may be limited to 20 kg per package and packages are delivered by TNT.

The delivery is made at the delivery address specified by the Customer, provided The address shall be the address of residence of the Customer or of any person of his choice in metropolitan France. Delivery cannot be performed neither in hotels nor in PO boxes.

In order to ensure that the deadlines are met, the Customer must ensure that accurate and complete data regarding the delivery address such as street, building, stairs, access codes, names or interphone numbers, have been submitted.

The deadlines given by the Company mVmt to the Customer are indicative. Its corresponds to the average processing time and delivery. The Company mVmt cannot be held responisble for consequences due to a delayed delivery.

In case of a damaged package (already open, mising product, etc.), the Customer agrees to notify the carrier and the Company mVmt by all means within three days following the receipt of the package.


VI – Right of withdrawal
 

The Customer has a special right of withdrawal that he can use without cause within seven working days after the delivery of the order in the form of the return at the Customer's expense of the new products (in their original package, unworn (clothing), unmounted (bike or spare parts)) with the order number at the following address:

MVMT - Cycles Basement - 109 rue du Cheval - 63100 Clermont-Ferrand - FRANCE 

The Company mVmt shall reimburse the Customer of any amounts already paid, less any shipping charges, under the conditions specified by the article VII below.


VII - Reimbursement

Reimbursement of the products in the cases referred to in articles II and VI will be mad eby the Company mVmt within 30 days after the receipt of the returned products. Reimbursement will be made following the same method of payment chosen by the Customer at the time of order or by a delivery voucher.


VIII – Applicable Law


Any order implies the full acceptance by the Customer of the general conditions of sale. These terms and conditions of sale are governed by the French Law. In case of dispute, French courts will have juridiction. In case of difficulty or complaint regarding an order, the Customer may contact the  Customer Service to find an amicable solution.

IX – Data Protection

The data collected by the Company mVmt during the Customer's order is required to manage the transaction and to this end may be communicated to all or parts of the Company mVmt's providers involvedin the execution of the order. The Customer is informed that these p ersonal data will be collected by an organization responsible for the analysis of orders and for the fight against credit card fraud. In accordance with the Data Protection Law Act No. 78-17 of January 6 1978, the Customer has right to access, rectify, oppose or delete data.
